TERMS AND CONDITIONS OF USE OF THE WEBSITE
These Terms and Conditions, hereinafter referred to as "Terms and Conditions", regulate the intermediation services for the purchase and sale carried out by the website Haven Home, hereinafter referred to as "INTERMEDIARY".
1) Any individual, hereinafter referred to as "BUYER", who intends to use the services of Haven Home, must accept the Terms of Use and all other policies and principles that govern them.
2) ACCEPTANCE OF THESE TERMS AND CONDITIONS IS ESSENTIAL TO USE THE SITES AND SERVICES PROVIDED BY HAVEN HOME.
3) The USER must read, ensure they have understood, and accept all provisions established in the Terms and Conditions and the Privacy Policy before successfully registering as a "buyer".
II – THE BUYER:
4) The services are only available to individuals who have full legal capacity to contract. Thus, individuals under 18 years old or those with other disabilities mentioned in Articles 3 and 4 of the Brazilian Civil Code may not register unless they are duly represented or assisted.
5) Haven Home does not provide services for legal entities, limiting its services to intermediation between individuals.
6) The "BUYER" agrees to provide their personal information truthfully and accurately, updating it whenever any changes occur.
7) Haven Home is not responsible for the truthfulness of the information provided by the "BUYER", and the buyer assumes full responsibility for its content.
8) Haven Home may verify the accuracy of the "BUYER" registration data at any time. If it finds incorrect or false information or if the "BUYER" refuses or fails to submit the requested documents, Haven Home may block the "BUYER" until the issue is resolved.
III – THE SERVICE PROVIDED:
9) Haven Home is a website that aims to mediate the purchase and sale of imported products, with compensation for each "transaction" carried out.
10) Haven Home limits its transactions to importing exclusively between individuals, not mediating transactions between individuals and legal entities.
11) The services provided by Haven Home will be remunerated through a percentage based on the "transaction" value.
12) Haven Home does not supply any products or advertise them on the site. Haven Home provides a service that connects the "BUYER" with products and goods from the supplier, which may be domestic or imported products.
13) The "INTERMEDIARY" cannot be held responsible for the right of withdrawal of products purchased on the Haven Home website, acting solely as an intermediary between the parties involved.
IV – BUYER'S CAPACITY:
14) The services provided by the "INTERMEDIARY" are available only to individuals with legal capacity to contract.
15) The "INTERMEDIARY" does not engage in transactions with "BUYERS" who lack civil capacity (individuals), without prejudice to the legal sanctions set out in the Brazilian Civil Code, notably Articles 166, I; 171, I, and 180.
V – MODIFICATIONS TO THE TERMS AND CONDITIONS:
16) The "INTERMEDIARY" may modify these Terms and Conditions at any time, aiming to improve the services provided. The new Terms and Conditions will come into effect 10 (ten) days after their publication on the Sites. Within 5 (five) days of the publication of the new version, the "BUYER" must contact by email if they disagree with the changes. In such a case, the contractual relationship will no longer exist. If no response is provided within the stipulated period, the "BUYER" is deemed to have accepted the new Terms and Conditions, and the contract will remain binding. Changes will not apply to transactions that were already initiated before their publication, in which case the previous version will remain valid.
VI – ADVERTISED PRODUCTS AND LIMITATION OF LIABILITY:
17) The "BUYER" acknowledges that the "INTERMEDIARY" does not have the products in stock, and these are available from the "SUPPLIER".
18) The "BUYER" understands and expressly agrees that, to the extent permitted by applicable law, the "INTERMEDIARY" will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damages for lost profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the Service.
19) To the extent permitted by applicable law, under no circumstances will the "INTERMEDIARY" be responsible for lost profits or any special, incidental, or consequential damages arising from or related to our website, our Services, or these Terms of Service (regardless of the origin, including negligence).
20) The "INTERMEDIARY" does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, nor does it guarantee that the results obtained from using the Services will be accurate or reliable.
21) The "INTERMEDIARY" does not guarantee the quality of the products, services, information, or other materials purchased or obtained by the "BUYER".
22) The "INTERMEDIARY" does not offer refunds.
VII – PAYMENT OF FEES:
23) The "BUYER" is responsible for all applicable taxes arising from or resulting from the purchase of products. The applicable tax rates are calculated based on the billing address provided by you. These amounts are additional to the product and service fees and will be charged using your Authorized Payment Method.
VIII – PRIVACY AND DATA PROTECTION:
24) Haven Home is firmly committed to protecting the privacy of your personal information and that of the "BUYER". By using the Service, you acknowledge and agree that the collection, use, and disclosure of personal information by Haven Home is governed by our Privacy Policy.
